This Privacy Policy is designed to help you understand how My School Dance (“Think Tank NTG”, “we”, or “us”) collects and uses the personal information you decide to share, and helps you make informed decisions when using myschooldance.com (the “Site”). By using or accessing myschooldance.com or related My School Dance sites, you are accepting the practices described in this Privacy Policy. This Privacy Policy is governed by our Terms and Conditions. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICES.

We may make changes to the policy from time to time so please be sure to check regularly. If we make a material change to this policy and we have your contact details we will contact you before we make the change.

There are many different ways you can use our services – to share information and forms, to communicate with other people in your school, or to create new content. When you share information with us, for example by creating an Account, we can make those services even better, helping you connect with people or to make sharing with others quicker and easier. As you use our services, we want you to be clear how we’re using information and the ways in which you can protect your privacy. Our Privacy Policy explains:

  • What information we collect and why we collect it;
  • How we use that information;
  • The choices we offer, including how to access and update information.

We’ve tried to keep it as simple as possible, but if you’re not familiar with terms like cookies, IP addresses and browsers, then read about these key terms first. Information we collect from children

Myschooldance.com is intended for high school students and educators. In the event that a user 12 and under attempts to create an account on the Site, we ask that they provide a parent’s email address. We use this email address to notify the parent of their child’s wish to use the Site and ask that the parent create an account and provide their name, email address, phone number, date of birth and street address (optional). The parent can then add a student profile for their child. This student profile includes a first name, last name, date of birth, grade, school name and county. The parent manages the student account and receives information on events and tickets through their online contact information. We store this information as long as necessary to provide the service. The parent can review or update their child’s information or request that it is deleted at any time.

Information we collect

Our primary purpose in collecting personal information is to provide you with a safe, secure online application which will assist you in sharing information and forms, to communicate with other people in your school, or to create new content. In order to do so, My School Dance must collect information to identify users, and to allow our users to identify each other. We only collect information about you that we consider necessary for achieving this purpose.

We collect information in two ways:

Information you give us

For example, many of our services require you to sign up for a My School Dance Account. When you do, we’ll ask for personal information, like your name, email address, telephone number or credit card (not stored). We may present your name, email address or image to other users in your school, or otherwise associated with your My School Dance account in order to assist in sharing or recommendations.

You may also choose to provide the following:

  • Social Media Account Information

When you use a social media account to sign in to the Services, you provide us with the user ID associated with any social media account (e.g. Google +) that you use. If you sign in with or otherwise connect your social media account to the Services, you authorize us to collect, store, and use in accordance with this Privacy Policy any and all information available to us through the social media interface. This includes, without limitation, any information that you have made public in connection with your social media account, information that the social media service shares with us, or information that is disclosed as being shared during the sign-in process. Please see your social media provider’s privacy policy and help center for more information about how they share information when you choose to connect your account.

  • User Generated Content

If you choose to upload your own Resources to the Resource page, you provide us with that information and it may be available to other users and even the public. This means that it can be read, collected, and used by others without our knowledge, including sending unsolicited communications.

  • Profile Information

Our Services may allow users to search for other users and view those user’s public profile information (also called your “ID”). To change the information appearing in your public profile or to make this information private, please visit your account settings.

  • Information about others

You may provide us with information about others when you use the service. You are responsible for receiving prior authorization from the person or entity that you are providing information of. This could be personal information, such as a name, email address, telephone number or credit card.

  • Create and Send Forms

When users create Dances and Dance Agreements through our Services and arrange for them to be sent to recipients, they’ll provide information such as names and email addresses of the recipients. If users want additional assurances about the identity of the individual signing their agreements or contracts, they may require us to collect some additional information that we use to authenticate recipients before they are able to sign an agreement or contract.

Information we get from your use of our services

We may collect information about the services that you use and how you use them. An example would be when you visit a website that uses our services or you view and interact with our content. This information includes:

  • Device Information

We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). My School Dance may associate your device identifiers or phone number with your My School Dance Account.

  • Log Information

When you use our services or view content provided by My School Dance, we may automatically collect and store certain information in server logs. This may include: Details of how you used our service, such as your links accessed and created or search queries; Telephone log information such as your phone number.

  • Internet Protocol address

Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request, referral URL, cookies that may uniquely identify your browser or your My School Dance Account.

  • Location Information

When you use a location-enabled My School Dance service, we may collect and process information about your actual location, such as GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may provide information on nearby Wi-Fi access points and cell towers.

  • Unique application numbers

Certain services include a unique application number. This number and information about your installation (the operating system type and application version number) may be sent to My School Dance when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates.

  • Transactional Data

Data relating to the forms or contracts you upload or sign on the Services, such as: Agreement metadata, Agreement or contract subject, authentication method used, and Agreement or contract history.

  • Local Storage

We may collect and store information, including personal information, locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

  • Cookies and anonymous identifiers

We use various technologies to collect and store information when you visit a My School Dance service, and this may include sending one or more cookies or anonymous identifiers to your device. We also use cookies and anonymous identifiers, such as beacons, tags and scripts when you interact with services we offer to our partners. For instance, advertising services or My School Dance features that may appear on other sites.

  • Information from other sources

We may obtain information about you from other sources such as marketers, partners, affiliates under common ownership or control with My School Dance, researchers, and others. For example, if you register for My School Dance on another website or use a website that facilitates your activity on My School Dance, that website may provide information about you and your transactions to us.

How we use information we collect

We use the information we collect from all of our services to facilitate the transaction and online services that you are engaged in with My School Dance or a third party such as a school, club or business that you’re associated with. We also use the information we collect from all of our services to provide, maintain, improve, develop new services, and protect My School Dance and it’s users.

We may use the name you provide for your My School Dance Profile across all of the services we offer that require a My School Dance Account. In addition, we may replace past names associated with your My School Dance Account so that you are represented consistently across all our services. If other users (such as administrators) already have your email, or other information that identifies you, we may show them your publicly visible My School Dance Profile information, such as your name and photo.

If you use My School Dance to send documents, we will encrypt and store these documents in an account. We will then make the contents available only to those whom you invite to view or sign these files. We restrict our employees access to this information so that their access is only necessary to provide services.

When you contact My School Dance, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements. If you send us personal correspondence, such as emails or requests for walk-throughs, we may collect information, such as name, email address, and phone number, into a file specific to you.

If you register for My School Dance on another web site, use a web site providing a service for My School Dance, or a web site that helps facilitate your activity on My School Dance, that web site may provide personal information about you and your transactions back to My School Dance.

We use information collected from cookies and other technologies to improve your user experience and the overall quality of our services.

We may combine information from one service, including personal information, into other My School Dance service – for example to make it easier to share things with people you know.

We may aggregate and/or de-identify the information we collect to limit or prevent identification of any particular user or device. Our use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.

We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy. My School Dance processes personal information on our servers. We may process your personal information on a server located outside the state where you live.

Information you share

Many of our services let you share information with others. Remember that when you share information publicly, it may be indexable by search engines. Our services provide you with different options on sharing and removing your content.

In order to facilitate interaction among all My School Dance users, our product may allow you limited access to other user’s contact and authentication status information.

By entering into our User Agreement, you agree that, with respect to other user’s information that you obtain through the site or through a My School Dance-related communication or My School Dance-facilitated transaction, My School Dance hereby grants to you a license to use such information only for:

  • My School Dance-related communications that are not unsolicited commercial messages;
  • Using services offered through My School Dance (e.g. message or document sending, signing, payment transactions, etc.);
  • Any other purpose that a user expressingly agrees to after you tell them the purpose you would like to use it for.

In all cases, you must give users an opportunity to withdraw consent to sign electronically. In addition, under no circumstances, except as defined in this section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in accordance with this section.

Accessing and updating your personal information

Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it, unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We will retain in our files some personal information, past documents, forms and transactions to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our User Agreement, and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from user viewing and will only be available to select My School Dance personnel.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

Information we share

We do not share, sell, or rent any of your personal information with companies, organizations, and individuals outside of My School Dance unless one of the following circumstances apply:

  • With your consent (creating an account with My School Dance does not imply consent, you must directly contact us with this consent at support@myschooldance.com)

We could share personal information with companies, organizations, or individuals outside of My School Dance when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information with account administrators.

If your My School Dance Account is managed for you by an organization administrator then your organization’s administrator will have access to your My School Dance information (including your email and other data). Your account administrator may be able to:

    • View statistics regarding your account;
    • Change your account password;
    • Suspend or terminate your account access;
    • Access or retain information stored as part of your account;
    • Receive your account information in order to satisfy applicable law, Regulation, legal process or enforceable governmental request;
    • Restrict your ability to delete or edit information.

Please refer to your account administrator’s privacy policy for more information.

  • For Internal Service Providers

We may use third parties, that we refer to as Internal Service Providers, to facilitate or outsource one or more aspects of the business, product, and service operations that we provide to you (e.g., search technology, authentication systems, bill collection, fraud detection, and a customer support vendor to provide live chat services). We may provide some of your personal information directly to these internal service providers. These internal service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced My School Dance related operation, unless you have explicitly agreed or given your prior permission to them for additional uses.

  • For incidence response and maintenance

We may share personal information with third-party service providers of My School Dance in order to perform maintenance or respond to technical incidents affecting our services. Information will only be shared if it is deemed essential to the required operations and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

  • For legal reasons

We will share personal information with companies, organizations, or individuals outside of My School Dance if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:

    • Meet any applicable law, regulation, legal process or enforceable governmental request;
    • Enforce applicable Terms of Service, including investigation of potential violations;
    • Detect, prevent, or otherwise address fraud, security or technical issues;
    • Protect against harm to the rights, property, or safety of My School Dance, our users, or the public as required or permitted by law.
  • With Social Media Services (where directed by you)

If you connect to a third-party service (such as Google+) through an icon or link on the services or otherwise link your account with a third-party service, you may share the contents of your post and associated information (such as your user name, the fact that your connection originated from My School Dance services) with such third party. Once such information is shared, the use of your information will be subject to that service’s privacy policy and this privacy policy will not apply.

  • With Affiliates

We may share your information with other companies under common ownership or control with My School Dance. We may share aggregated, nonpersonally identifiable information publicly and with our partners, such as publishers, advertisers, or connected sites. For example, we may share information publicly to show trends about the general use of our services. This could also include government bodies, industry groups, insurers, and educational/training facilities.

If My School Dance is involved in a merger, acquisition, or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this privacy policy. Therefore, although we use industry-standard practices to protect your privacy, and you should know that we will take all reasonable steps to provide you a highly secure environment.

Other information collectors

Except as otherwise expressed in this privacy policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties using our system or follow links to other sites, different rules may apply to their use or disclosure of the information you disclose to them.

Since My School Dance does not control the privacy policies of third parties, or other individual’s actions, you are subject to the privacy policies of that third party or those individuals. We encourage you to be sure the recipients are authenticated to your satisfaction before you send them any documents.

We may use a third-party service provider to conduct these surveys to better provide our services to you; that company is prohibited from using our user’s personally identifiable information for any other purpose.

Transparency and choice

People have different privacy concerns. Our goal is to be clear about what information we collect, so that you can make meaningful choices about how it is used and control who you share information with.

You may also set your browser to block all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us. However, it’s important to remember that many of our services may not function properly if your cookies are disabled. For example, you may not be able to login to My School Dance or utilize other services.

How we protect information

We work hard to protect My School Dance and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many of our services using Secure Sockets Layer (SSL) or Transport Layer Security (TLS);
  • We encrypt many of our systems using industry standard solutions;
  • We review our information collection, storage and processing practices, including physical security measures to guard against unauthorized access to systems;
  • We restrict access to personal information to My School Dance employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

Control of your password

You are responsible for all actions taken with your User ID and password, including fees charged to your account and all actions taken with your account. Therefore, we do not recommend that you disclose your My School Dance password to any third parties. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. If your password has been compromised for any reason, you should immediately change your password.

Your California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. As discussed above, we do not currently share personal information with third parties for their own marketing purposes.

Application of the Policy

Our privacy policy applies to all of the services offered by My School Dance and its affiliates, including services offered on other sites, but excludes services that have separate privacy policies that do not incorporate this privacy policy.

Our privacy policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include My School Dance services, or other sites linked from our services. Our privacy policy does not cover the information practices of other companies and organizations who advertise our services.

Enforcement of the Policy

We regularly review our compliance with our privacy policy. We also adhere to several self-regulatory frameworks. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

ADA Compliance

In order to comply with Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act of 1990, My School Dance will meet the Web Content Accessibility Guidelines (WCAG) 2.0 AA, as instituted by the World Wide Web Consortium’s (W3C) Web Accessibility Initiative (WAI), unless in a particular situation doing so would not be feasible or otherwise imposes an undue burden.

The Web Content Accessibility Guidelines (WCAG) are part of a series of web accessibility guidelines published by the Web Accessibility Initiative (WAI) of the World Wide Web Consortium (W3C), the main international standards organization for the Internet. They are a set of guidelines that specify how to make content accessible, primarily for people with disabilities—but also for all user agents, including highly limited devices, such as mobile phones.

For the My School Dance backend application (https://app.myschooldance.com), My School Dance is committed to compliance with the provisions of the Americans with Disabilities Act (ADA), and Sections 504 and 508, as applicable, so that students, parents and members of the public with disabilities are able to independently acquire the same information, engage in the same interactions, and enjoy the same benefits and services within the same time frame as those without disabilities, with substantially equivalent ease of use. My School Dance strives to ensure that members of the public with disabilities are not excluded from participation in, denied the benefits of, or otherwise subjected to discrimination when using My School Dance.

Any non-conforming aspect of the application will be corrected in a timely manner.

Website Accessibility Concerns, Complaints and Grievances

A student, parent or member of the public who wishes to submit a complaint or grievance regarding a violation of the Americans with Disabilities Act (ADA), or Section 504 and 508, as applicable, related to the accessibility of the My School Dance application may file a complaint.

Filing a Complaint:

Complaints or grievances regarding the inaccessibility of the My School Dance application content should be submitted in writing, via email to the My School Dance support team support@myschooldance.com, or through the “Contact Us” tab on the My School Dance application login page.

The Complainant should submit a description of the problem, including:
• Name
• Address
• Date of the Complaint
• Description of the problem encountered
• Web address or location of the problem page
• Solution desired
• Contact information in case more details are needed (email and phone number)

The Complainant shall be contacted no later than ten (10) working days after the complaint is received.

Complaint Investigation Procedures:
• An investigation of the complaint shall be completed within ten (10) working days of the Complainant being contacted, unless an extension is required by the school division.
• The investigator shall prepare a written report of the findings and conclusions within ten (10) working days of the completion of the investigation.
• The investigator shall contact the Complainant upon conclusion of the investigation to discuss the findings, conclusions and actions to be taken as a result of the investigation.
• A record will be kept of each complaint and grievance made. The record shall include a copy of the complaint or grievance filed, a report of findings from the investigation, and the disposition of the matter.
